Font Software End-User License Agreement (EULA)

Version 1.1 — Effective June 2026

Please read this agreement before installing or using any font software described in the Order Invoice (collectively "the Fonts") owned, licensed, or distributed by Małgorzata Bartosik, operating under the name Mbar Type("We", "Us" or "Our"). This Font Software End-User License Agreement ("Agreement") is a contract between Us and the party stated in the Order Invoice ("You" or "Your") and governs what You can and cannot do with the Fonts. By installing, copying, or using any portion of the Fonts, You accept and agree to this Agreement. If You do not agree to all terms and conditions, do not use or install the Fonts.

The Fonts are licensed, not sold. Obtaining a license gives You the right to use the Fonts in accordance with the terms of this Agreement, any applicable Addendum(s), and the Order Invoice received upon purchase. The Order Invoice is incorporated into and made part of this Agreement.

1. Grant of License

Upon receipt of Your payment, We grant You a non-exclusive, royalty-free, non-assignable, non-sublicensable, and revocable license to use the Fonts for the Permitted Uses specified in the Order Invoice and the applicable Addendum(s). The license is perpetual unless otherwise stated. The territory is worldwide unless otherwise stated. This non-exclusive license does not preclude Our right to license the Fonts to other users.

You agree that You: (i) shall not transfer, give access to, or distribute any part of the Fonts to any third party without Our prior written consent; (ii) shall not attempt to emulate, mimic, or create a substitute for any Fonts, including by outlining; (iii) shall comply with this Agreement.

If You are a business entity purchasing a license for use by employees or agents, You shall notify them of the terms of this Agreement and ensure they abide by it.

2. Permitted Uses & Restrictions

a. Copying

You may make a reasonable number of backup copies of the Fonts for archival purposes only. You may transmit a digital copy to a commercial printer solely for outputting a specific document, provided the printer agrees to use the Fonts exclusively for Your work and retains no copies upon completion. You are liable for any misuse by such third parties.

b. Modifications

You may create modified versions of the Fonts for Your own internal use, provided You: (i) do not distribute any modified versions to any third party; (ii) include all original intellectual property notices; (iii) acknowledge that We provide no technical support for modified fonts and accept no liability; (iv) agree that the terms of this Agreement apply to any modified fonts.

c. Commercial Letterform Products

You may not use the Fonts in letterform-related products, including rub-on letters, rubber stamps, stencil alphabet sets, adhesive letters, print-on-demand products, or reproductions of individual letterforms for signage, numbering, or scrapbooking. A separate license may be purchased for such uses.

d. Restriction on Transfer

You may not rent, lease, sublicense, or assign any portion of the Fonts except as expressly stated in this Agreement. You may not authorize any individual or entity to copy the Fonts onto their own computer.

e. Security

You shall use commercially reasonable precautions to prevent unauthorized third parties from accessing or using the Fonts.

f. Embedding

You shall not use the Fonts to create or distribute any electronic document in which the Fonts or any part thereof are embedded, unless covered by a specific Addendum.

g. Contractors and Vendors

If the License is for a business, it extends to employees and internal contractors working under Your direction and control, as specified in the Order Invoice. You shall not share the Fonts with external contractors, affiliates, vendors, or other third parties outside the licensed business entity.

h. AI Training

You shall not use the Fonts for the purpose of training Artificial Intelligence or machine learning algorithms.

3. Intellectual Property Ownership

We retain all rights, title, and interest in and to the Fonts, including all intellectual property rights. The Fonts are protected by copyright and other applicable laws. No right, title, or interest in any Fonts is transferred to You as a result of this Agreement. You acknowledge that You have no rights in or to the Fonts beyond the scope of the License.

4. Termination with Cause

We may terminate this Agreement immediately if You breach any of its terms. Upon termination, You shall cease all use of the Fonts and immediately destroy all copies in Your possession. Termination does not preclude Us from seeking legal or equitable remedies.

5. Governing Law, Jurisdiction and Dispute Resolution

This Agreement is governed by the laws of the Republic of Poland. You consent to the jurisdiction of Polish courts to enforce the provisions of this Agreement and to resolve any disputes arising out of or related to it.

In the event of any dispute, You agree to attempt in good faith to negotiate a resolution with Us for at least 45 calendar days before pursuing any other remedy. You shall pay Our reasonable attorneys' fees and costs incurred in connection with any breach of this Agreement.

6. No Warranties, Limitation of Liability and Indemnity

We strive to produce the Fonts to the highest technical standards. If You experience technical difficulties with the Fonts and notify Us within 90 days of the purchase date, We will work with You to resolve the issue. If We determine the issue is a technical failure of the Font software and cannot resolve it within 10 business days, We will refund the purchase price. In such case, this License is automatically terminated.

WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. NEITHER PARTY WILL BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS. OUR LIABILITY WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE FONTS GIVING RISE TO THE LIABILITY.

7. Business and Organizational Users; Audits

Any individual installing or using the Fonts on behalf of a business warrants that they have authority to legally bind that business.

If You are a business with 20 or more employees, You grant Us the right to audit Your use of the Fonts during normal business hours to confirm compliance. If the audit reveals noncompliance, You shall reimburse Us for audit expenses and purchase any additional licenses required within 15 calendar days.

8. Updates

We may update or modify this Agreement at any time to preserve its original intent and the permitted uses of the Fonts. We will notify You of any update. Your continued use of the Fonts following notification constitutes acceptance of the updated Agreement. Updates will not be retroactive.

9. General Provisions

This Agreement is effective on the date You agree to it or install, copy, or use the Fonts, whichever is sooner. If any portion of this Agreement is found void or unenforceable, it will not affect the validity of the entire Agreement. This Agreement, any applicable Addendum(s), and the Order Invoice constitute the entire agreement with respect to the Fonts.

ADDENDA

Desktop Addendum

This Addendum applies if You purchased a Desktop license. It grants You the right to install and use the Fonts on the number of desktop computers (CPUs) specified in the Order Invoice.

License tiers: 1 desktop / Up to 3 desktops / Up to 10 desktops / Up to 25 desktops / Unlimited.

Permitted: Creating and distributing printed materials, static image files (PNG, JPG, PDF), presentations (PowerPoint, Keynote). Sharing the Fonts with a freelancer working directly on Your project, provided they delete all copies upon project completion.

Not permitted: Installing on more CPUs than licensed. Embedding in websites or apps without the appropriate additional license. Redistribution or sublicensing of the font files.

Web Addendum

This Addendum applies if You purchased a Web license. It grants You the right to use the Fonts as self-hosted web fonts on the domain stated in the Order Invoice, using the CSS @font-face mechanism.

License tiers based on monthly pageviews: Up to 10k / Up to 100k / Up to 500k / Over 1M.

Permitted: Embedding WOFF/WOFF2 files on the licensed domain and its subdomains. Use on static site generators and CMS platforms (WordPress, Webflow, Framer, etc.).

Not permitted: Hot-linking, re-serving, or re-directing that allows access to the Fonts by unlicensed parties. Use beyond the licensed pageview tier without upgrading. Embedding in native apps (requires App license).

If You wish to change the licensed domain, please notify Us via email at info@mbartype.com prior to the change. There is no charge for changing the domain, provided the new domain is owned by the same licensee.

App Addendum

This Addendum applies if You purchased an App license. It grants You the right to embed the Fonts in one compiled application ("App") per license purchased.

License tiers: 1 app / Up to 3 apps / Up to 10 apps / Unlimited.

Permitted: Embedding the Fonts within the application binary so that end users see the font rendered but cannot extract the font files. Distribution on app stores (Apple App Store, Google Play, etc.).

Not permitted: Bundling font files in a way that allows end users to extract them independently. Using the same App license for more than one distinct application title. Providing end users with the ability to use the Fonts to create customized products or documents outside the App.

Trial Fonts Addendum

This Addendum applies to Fonts downloaded on a free trial basis. Trial Fonts may be used for: (i) testing, evaluation, and comparison purposes; (ii) non-commercial, academic projects; (iii) private pitches and proposals for Your clients.

Trial Fonts may not appear in any published work, client deliverable, website, app, or commercial product. If You are uncertain whether Your intended use fits within the Trial Basis, please contact Us at info@funwithfonts.xyz before using the Fonts.

Third Party Distribution Addendum

The Desktop, Web, and App licenses do not grant unlimited rights to share Fonts with third parties outside the business entity specified in the Order Invoice. You may share the Fonts only with external contractors providing services to You that require the use of the Fonts, provided they: (i) use the Fonts exclusively for Your projects; (ii) do not retain any copies upon completion; (iii) do not transfer or distribute the Fonts to any other party; (iv) do not create a substitute for the Fonts.

You are responsible for any liability arising from use of the Fonts by external contractors.
